1. General Information

This website and online store (“Site”) is operated by Craftishly Ltd, a company registered in England and Wales (Company No. 14424007). Throughout these Terms, “we”, “us”, and “our” refer to Craftishly Ltd.

These Terms and Conditions apply to all use of our Site and all purchases made from us, whether online or in person at events or other physical sales locations.

By accessing our Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Site or services.

Our store is hosted by Shopify, which provides the technical platform for our online sales.

2. Eligibility to Purchase

You confirm that:

  • You are at least 18 years old; and
  • You are legally capable of entering into a binding contract under the laws of England and Wales.

3. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login details and all activity under your account.

You must ensure all information provided is accurate and up to date.

We may suspend or terminate accounts where we reasonably believe:

  • Information is false or misleading
  • Fraudulent activity is suspected
  • These Terms have been breached

Accounts must not be transferred or shared.

4. Orders & Contract Formation

Purchases are for personal or household use only and not for resale unless expressly agreed in writing.

When you place an order, you are making an offer to purchase goods from us.

An order is not accepted until we confirm acceptance by email. A contract between us is formed only at that point.

We may refuse or cancel any order where:

  • Goods are unavailable
  • Pricing or description errors occur
  • Fraud is suspected
  • Payment is not received
  • We reasonably believe cancellation is necessary for reasons including but not limited to commercial, operational, or risk-management reasons

If payment has been taken for a cancelled order, a full refund will be issued.

5. Products & Availability

We take reasonable care to ensure product descriptions, images, and pricing are accurate.

However:

  • Colours, finishes, packaging, and dimensions may vary slightly due to manufacturing differences and display settings
  • Minor variations between batches do not constitute defects

All products are subject to availability. We may:

  • Withdraw or discontinue products at any time
  • Limit quantities
  • Correct errors or inaccuracies

We reserve the right to correct pricing or product description errors and cancel orders where necessary to rectify such errors.

Customers are responsible for ensuring product compatibility where items are intended for use with third-party equipment or systems.

Workshop Bookings

Workshop bookings are governed by separate Workshop Terms & Conditions, which form part of your contract with us. In the event of any inconsistency, the Workshop Terms & Conditions shall prevail in relation to workshops.

6. Pricing & Payment

All prices are shown in GBP (£) and include VAT where applicable.

Shipping costs are displayed at checkout.

We use platforms such as Stripe to process payments securely. We do not store full payment card details.

By submitting payment information, you authorise the payment provider to charge your selected payment method.

We reserve the right to change prices or promotions at any time before order acceptance.

7. Delivery, Risk & Shipping

We aim to dispatch in-stock items within 48 hours, but all delivery times are estimates only.

We are not responsible for delays caused by couriers or circumstances outside our control.

Delivery Responsibility & Risk

Risk of loss or damage passes to you once goods are delivered to the address provided in your order.

Delivery is deemed completed when the courier confirms delivery, including where goods are:

  • Left in a safe place
  • Left with a neighbour
  • Delivered in accordance with instructions provided by you

Delivery may be evidenced by courier tracking, photographic evidence, GPS records, safe-place confirmation, or other courier data. These courier records may be relied upon as evidence of delivery unless rebutted with sufficient contrary evidence.

Where you provide delivery instructions, responsibility for delivery transfers once the courier confirms delivery in accordance with those instructions.

If you dispute delivery to a safe place that you did not authorise, it is your responsibility to raise and substantiate this claim directly with the courier, including any evidence they reasonably request.

We are not responsible for failed deliveries caused by incorrect or incomplete address details provided by you.

We may split orders into multiple deliveries.

8. Returns & Cancellation Rights (Online Orders Only)

For in-person or event sales, statutory cancellation rights under the Consumer Contracts Regulations 2013 do not apply. Refunds or exchanges are only offered for faulty or misdescribed goods.

Under the Consumer Contracts Regulations 2013, you may cancel your online order within 14 days of receiving your goods. You then have 14 days to return items after notifying us.

To be eligible for return, items must be:

  • Unused
  • In original packaging
  • In resaleable condition

Exclusions from Cancellation Rights

You cannot cancel or return:

  • Personalised or custom-made items
  • Perishable goods
  • Intimate or hygiene-sensitive items where the seal has been broken after delivery
  • Digital downloads or digital content once access has been provided
  • Any other goods exempt under UK law

Return Costs

Unless goods are faulty or we provide a returns label, you are responsible for return postage costs.

9. Refunds, Faults & Exchanges

Once returned items are received and inspected, we will notify you of approval or rejection of your refund.

Approved refunds are issued to the original payment method. Refunds may take several business days to appear in your account depending on your payment provider.

Deductions

We may reduce refunds where goods show:

  • Use beyond what would reasonably be necessary to inspect them in a retail environment;
  • Damage, wear, or handling that reduces resale value; or
  • Costs reasonably incurred in restoring the goods to a resaleable condition where permitted by law.

Faulty or Misdescribed Goods

Under the Consumer Rights Act 2015, goods must be:

  • Of satisfactory quality
  • Fit for purpose
  • As described

If goods are faulty, damaged, or misdescribed, you may be entitled to a repair, replacement, or refund depending on the circumstances.

We may request evidence or return of goods for inspection.

Exchanges are offered only where appropriate and subject to stock availability.

10. Digital Content & Product Safety

Digital downloads and content are licensed for personal use only unless otherwise stated.

You may not:

  • Copy, share, resell, or redistribute digital content
  • Modify or use content commercially without permission

Digital content is non-refundable once access or download has been provided, except where required by law.

Some products may contain sharp edges, small parts, or materials requiring careful handling. Customers are responsible for safe use and appropriate supervision where necessary.

You are responsible for ensuring products are used in accordance with any instructions provided and kept safely out of reach of children where appropriate.

11. Intellectual Property

All content on the Site is owned by or licensed to Craftishly Ltd.

You may not reproduce, distribute, modify, or commercially exploit any content without prior written permission.

12. User Content & Feedback

If you submit reviews, feedback, or content (“Feedback”), you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use, reproduce, adapt, publish, translate, distribute, and display such Feedback for any business purpose.

This includes marketing, advertising, product development, customer support, and operational use.

We may edit Feedback for clarity, formatting, or presentation, provided the meaning is not materially altered.

You confirm:

  • You own or have rights to the Feedback
  • It is lawful and accurate
  • It does not infringe third-party rights

We may remove or refuse to publish Feedback at our discretion.

13. Acceptable Use & Automated Access

You agree not to use the Site for unlawful purposes or in any way that could harm its operation or security.

You must not:

  • Use bots, scrapers, crawlers, or automated systems to access or extract data from the Site
  • Attempt to bypass technical protections or security measures
  • Interfere with Site performance or infrastructure

We may block or restrict access where we reasonably suspect misuse.

14. Third-Party Services & Links

We may link to third-party services or tools.

We are not responsible for:

  • Their availability
  • Their security or practices

Use of third-party services is at your own risk.

15. Shopify Platform

Our store is hosted by Shopify, which provides the e-commerce infrastructure.

All contracts for sale are between you and Craftishly Ltd. Shopify is not responsible for any transaction, product, or customer service matters.

16. Privacy & Data Protection

We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

Details of how your data is collected, used, and stored are set out in our Privacy Policy, which forms part of these Terms.

Craftishly Ltd is the data controller of your personal data.

17. Liability

Nothing in these Terms excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded by law

To the fullest extent permitted by law, we are not liable for:

  • Loss of profits
  • Loss of business
  • Loss of revenue
  • Loss of data
  • Indirect or consequential losses

You agree not to initiate unjustified chargebacks or payment disputes without first contacting us to resolve the issue. We may provide evidence of fulfilment, including tracking and delivery confirmation, to your payment provider in the event of a dispute.

Our total liability shall not exceed the total amount paid by you for the relevant goods giving rise to the claim.

18. Indemnity

You agree to indemnify us against any losses arising from:

  • Your breach of these Terms
  • Your unlawful use of the Site
  • Your infringement of third-party rights

19. Termination

We may suspend or terminate access to the Site or your account where we reasonably believe:

  • These Terms have been breached;
  • Fraudulent or suspicious activity has occurred;
  • There is a risk to the security, integrity, or availability of the Site; or
  • It is reasonably necessary to protect our customers, suppliers, or business operations.

We may also restrict or terminate access where continued use would reasonably be considered detrimental to the operation or reputation of Craftishly Ltd.

Termination shall not affect any rights or obligations accrued before termination.

20. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

21. Changes to These Terms

We may update these Terms from time to time. Changes will take effect when published on this page.

These Terms constitute the entire agreement between us and supersede all prior or contemporaneous communications, representations, or understandings, whether written or oral.

Continued use of the Site constitutes acceptance of updated Terms.
